ORDINANCE NO. BL2001-689

An ordinance authorizing Pulte Homes, Tennessee LP, hereinafter known as "PULTE" to participate with the Metropolitan Government, Department of Water and Sewerage Services, hereinafter known as "METRO" for the construction of Project No. 97-SG-84, Owl Creek Trunk Sewer.

WHEREAS, METRO provides sewerage service in Williamson County; and

WHEREAS, PULTE has expressed a desire to provide improved public sewer service in northeast Williamson County, TN, hereinafter known as Chestnut Springs Subdivision Phase 1, Lots 1-4, 71-147 and the Clubhouse (total of 82 Units); and

WHEREAS, METRO has funded and built the Owl Creek Trunk Sewer Project No. 97-SG-84 anticipating participation from developers at $2,000 for capacity fees; and

WHEREAS, it is deemed to benefit both parties and the general community and PULTE is agreeable to paying its proportionate share of the total cost in an amount not to exceed $164,000; and

WHEREAS, this work is identified in METRO's Capital Improvements Budget as Project No. 96-SG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That METRO is hereby authorized to accept from PULTE an amount not to exceed $164,000 to aid in the construction of sewer improvements for the Chestnut Springs Subdivision Phase 1, the Clubhouse and Owl Creek Trunk Sewer Project No. 97-SG-84.

SECTION 2: That future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
