ORDINANCE NO. BL2001-688

An ordinance authorizing Centex to participate with the Metropolitan Government, Department of Water and Sewerage Services, for the construction of Project Nos. 99-SL-206 & 97-SG-84, Willowmet Phase 1 Subdivision and Owl Creek Trunk Sewer.

WHEREAS, Centex has expressed a desire to provide improved public sewer service in northeast Williamson County, TN, hereinafter known as Willowmet Phase 1 Subdivision & Owl Creek Trunk Sewer, Project Nos. 99-SL-206 & 97-SG-84; and

WHEREAS, it is deemed to benefit both parties and the general community, and Centex is agreeable to paying its proportionate share of the total cost in an amount not to exceed $42,000 to provide sewerage service to 21 lots; and

WHEREAS, Metro Government provides sewerage services in Williamson County; and

WHEREAS, each developer is required to pay $2,000 per connection to repay construction cost of the trunk sewer; and

WHEREAS, this work is identified in Metro's Capital Improvements Budget as Project No. 96SG0002.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to accept from Centex an amount not to exceed $42,000 to aid in the construction of sewer improvements for the Willowmet Phase 1 Subdivision & Owl Creek Trunk Sewer, known as Project Nos. 99-SL-206 & 97-SG-84.

SECTION 2: Future amendments to this agreement shall be made by Resolution, approved by the Metropolitan Council, authorizing the Mayor to sign such amendments.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
