ORDINANCE NO. BL2001-687

An ordinance amending Section 7.16.030 of the Metropolitan Code by adding a portion of McGavock Pike to the list of streets, roads or avenues that a retail liquor store may front or abut and therefore continue to operate, provided the location held a valid certificate of compliance and license to sell liquor at retail on October 5, 1990, when Metropolitan Ordinance No. 090-1339 became effective.

WHEREAS, Metropolitan Code Subsection 7.16.030(A)(2) does require that retail liquor stores be located on or have their principal access to an existing major street or road as shown on the major street plan as adopted by the metropolitan planning commission;

WHEREAS, the owner of a retail liquor store fronting or abutting McGavock Pike, between Briley Parkway and Riverview Drive, does not presently qualify for a certificate of compliance, because that portion of McGavock Pike is not designated a major street on the Major Street Plan, as adopted by the metropolitan planning commission, although McGavock Pike east of Briley Parkway is so designated; and

WHEREAS, a retail liquor store fronting or abutting McGavock Pike, between Briley Parkway and Riverview Drive, had been continuously granted a certificate of compliance and a license to sell liquor at retail for over fifteen (15) years.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Metropolitan Code Section 7.16.030(C) is amended by adding the following new sub-section 4:
McGavock Pike between Briley Parkway and Riverview Drive.

SECTION 2. This Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
