ORDINANCE NO. BL2001-677

An ordinance approving an agreement for a conservation easement by and between John J. Kuczma, Jr. and The Metropolitan Government of Nashville and Davidson County, acting by and through the Board of Parks and Recreation.

Whereas, pursuant to Tenn. Code Ann. § 66-9-305 and Metropolitan Charter § 11.1002, the Metropolitan Government may accept donations of property for the purpose of establishing greenways and providing the public with recreational opportunities in natural areas; and

Whereas, pursuant to the agreement (the "Agreement") attached as Exhibit A and incorporated into this bill by reference, John J. Kuczma, Jr. proposes to donate and the Metropolitan Government, acting by and through the Metropolitan Board of Parks and Recreation, proposes to accept a parcel of property (the "Property") for inclusion as part of the Metropolitan greenway system; and

Whereas, acceptance of the proposed donation in accordance with the terms and conditions of the Agreement will help to enhance the entertainment and recreational opportunities for Nashville's citizens;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Agreement (Exhibit A) between John J. Kuczma, Jr. and the Metropolitan Government, acting through Metropolitan Board of Parks and Recreation, is hereby approved.

Section 2. Any amendment to the Agreement must be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
