ORDINANCE NO. BL2000-561
An ordinance amending Section 3.40.010 of the Metropolitan Code by providing a window of opportunity for employees to reconnect previous service with the Metropolitan Government for pension benefit purposes.
WHEREAS, Section 3.40.010 presently allows employees of Metropolitan Government who are re-employed to reconnect previous service for computing pension benefit service credit; and
WHEREAS, employees who were re-employed by Metropolitan Government prior to January 1, 1996, had one year to apply to the benefit board to receive such service credit for their prior period of service; and
WHEREAS, a number of employees did not make application to receive the prior service credit, and it is desired to allow employees who would otherwise qualify for prior service credit an opportunity to make application and receive such prior service credit.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1. Section 3.40.010 C. of the Metropolitan Code shall be and the same is hereby amended by adding the following new paragraph:
"Any provision to the contrary notwithstanding, any employee whose service was terminated and was subsequently rehired prior to September 1, 1996 shall be permitted to make application to the board and receive service credit for their prior period of service, provided such application is made to the board not later than December 31, 2001."
SECTION 2. From and after December 31, 2001, the provisions contained in Section 1 hereof shall be of no effect and shall be repealed without further action of the Metropolitan County Council.
SECTION 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
