ORDINANCE NO. BL2000-549

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a District to IWD District property at 12814 Old Hickory Boulevard, abutting the south margin of the CSX Railroad and the east margin of Interstate 24 (249.82 acres), (Proposal No. 2000Z-135G-13), all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By changing from AR2a District to IWD District property at 12814 Old Hickory Boulevard, abutting the south margin of the CSX Railroad and the east margin of Interstate 24 (249.82 acres), being more particularly described as being Property Parcel No. 23 as designated on Map 175 of the Official Property Identification Maps of The Metropolitan Government of Nashville and Davidson County, all of which is more particularly described by lines, words and figures on the attached plan, which is attached to and made a part of this ordinance as though copied herein.

SECTION 2. BE IT FURTHER ENACTED, That the Metropolitan Clerk is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause the change to be made on Sheet No. 175 of said Official Zoning Map for Metropolitan Nashville and Davidson County, as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 3. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. BL2000-549

Mr. President:

I move to amend Ordinance No. BL2000-549 by deleting the phrases "(249.82 acres)" and "Property Parcel No. 23" and substituting in lieu thereof "(227.82 acres)" and "part of Property Parcel No. 23", respectively, as they appear in Section 1, the attached sketch, and under Ownership of Record, and to insert the following condition as Section 2 and renumbering the remaining sections:

Section 2: That in order to ensure this rezoning does not pre-empt future opportunities to improve the road network in this area, including the proposed Southeast Arterial, the owner of this property shall dedicate right-of-way for the future extension of Crossings Boulevard and the Southeast Arterial as follows:

    1. In conjunction with any preliminary plat submittal for any portion of parcel 23, the applicant shall submit a traffic impact study. The scope of that study shall be determined by the Traffic Engineer.
    2. In conjunction with the submittal of the first final plat for any portion of parcel 23, the applicant shall dedicate sufficient right-of-way for Crossings Boulevard and the Southeast Arterial, as required by the Public Works Department and Traffic Engineer. The bonding for Crossings Boulevard shall be done with the first final plat submitted for any portion of parcel 23.
