ORDINANCE NO. BL2000-516

An ordinance amending Section 4.44.010 of the Metropolitan Code by changing the definition of "small business" in the provisions of the procurement code providing assistance to small and disadvantaged businesses to provide such assistance to Nashville, rather than United States, small and disadvantaged businesses.

WHEREAS, Section 4.44.010 presently defines "small business" as a United States business which is independently owned and operated, thereby providing assistance to "disadvantaged businesses" on a national rather than a local level; and

WHEREAS, the purposes of Chapter 4.44 of the Procurement Code is to provide assistance to small businesses owned or controlled by a majority of persons who have been deprived of the opportunity to develop and maintain a competitive position in the economy because of social disadvantages or disabilities; and

WHEREAS, by allowing small business within the entire United States to receive such assistance, the intended purpose to provide the assistance to businesses located in Nashville is being frustrated.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Section 4.44.010 of the Metropolitan Code shall be and the same is hereby amended by amending the definition of "small business" by deleting the phrase "United States" wherein it appears and substituting in lieu thereof the word "Nashville".

SECTION 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
