ORDINANCE NO. BL2000-494
An ordinance abandoning a portion of the water line and easement on Map 91-14, Parcel 268, (Proposal No. 2000M-086U-07) of Project No. 99-WL-121, DCS Enterprises Water Line and Easement Abandonment.
WHEREAS, DCS Investments, LLC, is the owner of real property encumbered by a water line and water easement; and,
WHEREAS, a new water line has been relocated on the south side of the existing building which adequately serves the property; and,
WHEREAS, approximately 180 feet of the water line and water easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-WL-121, DCS Enterprises Water Line and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,
WHEREAS, the Department of Water and Sewerage Services has no need for the said easements; and,
WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easements.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the water line and the water easement shown on Map 91-14, Parcel 268, Project No. 99-WL-121, is declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.
SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
