ORDINANCE NO.BL2000-477

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of the Metropolitan Government of Nashville and Davidson County, by amending Sections 17.16.030 and 17.20.030 regarding mobile home dwelling units all of which is more particularly described herein.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That Title 17 of the Code of Laws of The Metropolitan Government of Nashville and Davidson County, be and is hereby amended by making certain changes in the Official Zoning Map for Metropolitan Nashville and Davidson County, which is made a part of said Title 17 by reference, as follows:

By amending Section 17.16.030 (Uses Permitted with Conditions: Residential Uses – Mobile Home Dwelling) by deleting and adding language as follows:

B. Mobile Home Dwelling. In the mobile home park (MHP) zone district, the following supplemental development standards shall apply.\

1. Minimum size of park: two acres under single ownership

2. Maximum density: nine homes per acre.

3. Landscape Buffer Yard. Where the perimeter of a mobile home park development abuts an R or RS zone district, a minimum of landscape buffer yard Standard B-3 (15 feet) shall be applied, and where the development abuts a public street the minimum width of the buffer yard shall be C-2 twenty-five 30 feet.

4. Open space. A minimum of 10% of the total land area within the MHP, excluding roadways, drives, off-street parking areas and required setbacks, shall be designated as open space.

5. Mobile Home Park. Mobile home dwellings shall be permitted in a mobile home park on a two acre minimum tract under single ownership provided:

6. Minimum lot area: 4,000 square feet per each individual lot or lease plot

7. Minimum lot width: minimum of 40 feet

8. Setbacks:

9. public/private street or private drive: 20 feet

10. rear property or lease line: 10 feet

11. side property or lease line: 10 feet

12. Maximum height of any structure within the MHP: 30 feet

13. Maximum floor area ratio (non-residential): .60

14. Maximum impervious surface ratio: .70

a. Each individual plot for a mobile home dwelling shall be a minimum of two thousand four hundred square feet with a minimum width of thirty feet.

15. Street Standard. The mobile home park shall have direct access to an abutting improved public street designated or proposed as an arterial or collector street on the Major Street Plan. At a minimum, access and circulation within the park shall be provided by a paved driveway with a minimum width of 24 feet, permanently maintained by the landowner through conveyance of a private easement on a recorded property plat. If the paved driveway has visitor parking along it, the minimum pavement width of the driveway shall be increased to 27 feet.

16. Sidewalk. A sidewalk with a minimum width of 4 feet shall be provided along one side of all private drives within the MHP.

17. Tenant storage. A minimum of 90 cubic feet of enclosed tenant storage space shall be provided. The skirting of the undercarriage shall not be used for purposes of required tenant storage space.

18. Skirting of undercarriage. Each mobile home unit’s frame, axles, wheels, crawl space storage area, and utility connection shall be concealed from view through use of durable all-weather materials manufactured specifically for the purpose of covering the undercarriage area of the unit.

19. Board of Health Approval. A mobile home park development shall be reviewed and approved by the director of the metropolitan board of health in accordance with Chapter 10.40 of the Metropolitan Code of Laws and the rules and regulations promulgated by the metropolitan health department.

By amending Section 17.20.030 (Parking requirements established) by modifying the parking requirement for mobile home dwellings as follows:

Mobile home dwelling 2 spaces per unit plus 1 guest space for every 4 units for guest parking

SECTION 2. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage and such change be published in a newspaper of general circulation, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

 TO

 ORDINANCE NO. BL2000-477

 

Mr. President:

I move to amend Ordinance No. BL2000-477 by modifying as follows:

Chapter 17.16 (Land Use Development Standards)

·          Amend section numbering to make consistent with Zoning Ordinance format by consolidating standards #8, 9, 10, and 11 into one standard #5c and modifying numbering of remaining standards #12 – 18 to letters under standard #5;

 

·        Amend #5b by as follows:

 

b.      Minimum lot width:  minimum of 40 feet per each individual lot or lease plot.

 

·          Amend #5c by  adding the words “minimum of” for clarification;

·          Amend #18 to “j” and to place text in bold to indicate that it is a new standard being added;
