ORDINANCE NO. BL2000-442

An ordinance amending Section 7.08.090 of the Metropolitan Code by changing the method of measuring distances from beer permit holder’s premises to public school properties.

WHEREAS, Section 7.08.090 of the Metropolitan Code presently provides that when measuring the distance between the closest point of the applicant’s building to public schools for qualifications for a beer permit, the distance is measured from applicant’s building to the school building or school playground; and

WHEREAS, it is fitting and proper that under such circumstances the measurement be made from applicant’s building to the boundary of a public school of the metropolitan government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. Section 7.080.090 3. of the Metropolitan Code shall be and same is hereby amended by inserting after the phrase "from the closest point of the applicant’s building to closest boundary of a park;" the following provisions:

"and from the closest point of the applicant’s building to the closest boundary of a public school of the board of public education of the metropolitan government;"

SECTION 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

 TO

 ORDINANCE NO. BL2000-442

 Mr. President:

I move to amend Ordinance No. BL2000-442 by adding the following new Section 2 and renumbering the present Section 2 as Section 3:

Section 2. Section 7.080.090 3. shall be and the same is hereby further amended by inserting the following provision at the end of said subsection:

"The provisions contained in Section 1 hereof shall not affect any location for which a valid permit was in effect as of June 30, 2001."
