BILL NO. BL2000-402

An ordinance approving a cost-sharing agreement between The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation and the Department of the Army and appropriating the sum of forty-eight thousand dollars ($48,000) for planning work relating to the Richland Creek Greenway.

Whereas, the Department of the Army proposes to provide comprehensive plans (the "Project") for development, utilization and conservation of water and related land resources in connection with the Richland Creek Greenway; and

Whereas, the Project is to be undertaken in phases, with the cost of the first phase estimated to be ninety-six thousand dollars ($96,000) and the total cost of the Project estimated to be one hundred fifty thousand dollars ($150,000)

Whereas, the Department of the Army and the Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Parks and Recreation propose to share equally in the cost of the first phase of the Project in accordance with the terms set forth in the document attached as Exhibit A to this Ordinance (the "Agreement");

Whereas, The funds comprising the Metropolitan Government’s forty-eight thousand dollar ($48,000) contribution to the first phase of the Project have been appropriated and are to be derived from Fund 40204 bu 42408150; and

Whereas, the citizens of Nashville and Davidson County will benefit by participating in the Project as proposed.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. The Agreement is hereby approved.

Section 2. The Metropolitan Mayor is authorized to execute the Agreement.

Section 3. Any amendment to the Agreement may be approved by resolution of the Metropolitan Council receiving at least 21 affirmative votes.

Section 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
