ORDINANCE NO. BL2000-379

An ordinance accepting a grant agreement between the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs and The Metropolitan Government of Nashville and Davidson County for the improvement of the criminal justice system as provided by a drug control and systems improvement grant, specifically, the Edward Byrne Memorial Formula Grant Program.

Whereas, the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs has offered a grant in the amount of one million three-hundred fifteen thousand four-hundred twenty-two dollars ($1,315,422.00) to The Metropolitan Government of Nashville and Davidson County over a period of forty-two (42) months to be used and maintained by the Davidson County Sheriff’s Office for the provision of the Sheriff’s Alternative Sentencing Project; and

Whereas, it is deemed to be in the best interest of The Metropolitan Government of Nashville and Davidson County and its citizens to accept the grant from the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs for the use of the Davidson County Sheriff’s Office;

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. That the grant in the amount of one million three-hundred fifteen thousand four-hundred twenty-two dollars ($1,315,422.00) from the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs to The Metropolitan Government of Nashville and Davidson County for the provision of the Sheriff’s Alternative Sentencing Project, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan Mayor is authorized to execute the same.

Section 2. That The Metropolitan Government of Nashville and Davidson County shall provide a cash match of equal to or greater than 25% of the project budget or at least one hundred twenty-eight thousand three hundred fifty-one dollars ($128, 351.00) for fiscal year 2000-2001; one hundred twenty-four thousand fifty-one dollars ($124, 051.00) for fiscal year 2001-2002; one hundred twenty-four thousand fifty-one dollars ($124, 051.00) for fiscal year 2002-2003; and sixty-two thousand twenty-five dollars ($62, 025.00) for fiscal year 2003-2004.

Section 3. That any amendments shall be approved by resolution of the Metropolitan Council receiving twenty-one (21) affirmative votes.

Section 4. That this ordinance shall take effect from and after its final passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
