ORDINANCE NO. BL2000-355

An ordinance authorizing the purchase of property from the Department of Housing and Urban Development (HUD).

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to "…purchase…or otherwise acquire…property…for any public purpose."; and

WHEREAS, the Department of Housing and Urban Development (HUD) has for sale improved and vacant properties through its "$1 Homes to Local Governments" or other programs and these properties can be sold only to the local government within which the property is located; and

WHEREAS, the time frame for contracting to purchase said properties is fixed by the Federal Government at 10 (ten) days; and

WHEREAS, standard procedures for property acquisition by the Metropolitan Government cannot be followed and conform to said time frame; and

WHEREAS, these properties will subsequently be transferred to the Metropolitan Development and Housing Agency (MDHA) and said agency will reimburse the Metropolitan Government the total cost of acquiring the property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire from the Department of Housing and Urban Development (HUD) properties offered to local governments under the $1 Homes to Local Governments and other programs and to transfer said property to the Metropolitan Development and Housing Agency (MDHA) and to execute all necessary documents pertaining thereto to effect said purchase and subsequent transfer.

SECTION 2. This approval is strictly limited to properties offered by HUD and specifically designated as appropriate purchases and requested, in writing, by MDHA.

SECTION 3. The proceeds from the sale of these properties shall be credited to the General Fund of the Metropolitan Government.

SECTION 4. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
