ORDINANCE NO. BL2000-354

An ordinance amending Section 2.152.040 of the Metropolitan Code by adding a provision clarifying that the metro beautification and environment commission is not a board or commission of the Metropolitan Government.

WHEREAS, the metro beautification and environment commission is a division of the department of parks and recreation; and

WHEREAS, members of boards and commissions of the Metropolitan Government may not be employees of the Metropolitan Government unless specifically provided in the Charter of Metropolitan Government; and

WHEREAS, it is necessary to clarify that the metro beautification and environment commission as a division of the department of parks and recreation is not a board or commission controlled by the Charter provisions relating to membership qualifications.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Section 2.152.040 of the Metropolitan Code shall be and the same is hereby amended by adding the following new provisions:

"C. The metro beautification and environment commission is not and shall not be deemed to be a board or commission of the metropolitan government."

Section 2. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
