ORDINANCE NO. BL2000-327

An ordinance to approve the conveyance of a permanent easement for a water line to the Harpeth Valley Utility District on certain property owned by the Metropolitan Government (Tax Map 157, Parcel 1).

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Tennessee, owns certain property in Davidson County located on Highway 100 and designated as Edwin Warner Park (Tax Map 157, Parcel 1); and

WHEREAS, for the mutual benefit of a public water line extension that will also serve the Park, it was agreed to create and convey a permanent easement to the Harpeth Valley Utility District for the protection of said water line (as depicted on the attached Exhibit A) on a portion of said property; and

WHEREAS, the Department of Parks and Recreation has determined that the conveyance of this easement would not adversely affect the usage of said property.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The conveyance of a permanent easement (as depicted on the attached Exhibit A) on Tax Map 157, Parcel 1, is hereby approved.

SECTION 2. The Director of Public Property Administration is hereby directed to convey said easement and is authorized to execute the necessary documents pertaining thereto.

SECTION 3. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
