ORDINANCE NO. BL2000-298

An ordinance abandoning the sewer easements on Map 75, Parcels 118 and 147, (Proposal No. 2000M-035U-14) of Project No. 97-SL-42, Walden Woods Sewer Easement Abandonment.

WHEREAS, Mark W. and Nancy L. Provost and Michael Dewayne Pugh, Et Ux, are the owners of real property encumbered by sewer easements; and,

WHEREAS, new sewer lines have been installed and deeded which adequately serves the lots and the neighboring properties; and,

WHEREAS, the sewer easements are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 97-SL-42, Walden Woods Sewer Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer easements shown on Map 75, Parcels 118 and 147, and shown on Project No. 97-SL-42, are declared abandoned, and the below signed are hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
