ORDINANCE NO. BL2000-267

An ordinance abandoning the sewer lines and easements on Map 84-16, Parcel 119 and Map 95-4, Parcel 6 and 7, (Proposal No. 2000M-024U-14) of Project No. 99-SG-150, McGavock Pike Kroger Sewer Lines and Easement Abandonment.

WHEREAS, Southeast U. S. Retail Fund, L. P. is the owner of real property encumbered by sewer lines and sewer easements; and,

WHEREAS, new sewer lines have been installed along Lebanon Road which adequately serves the lots and the neighboring properties; and,

WHEREAS, the sewer lines and sewer easements are no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-SG-150, McGavock Pike Kroger Sewer Lines and Easement Abandonment, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easements; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easements.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer lines and the sewer easements shown on Map 84-16, Parcel 119 and Map 95-4, Parcel 6 and 7, and shown on Project No. 99-SG-150, are declared abandoned, and the Metropolitan Mayor or his designee is authorized to execute the appropriate instrument, copy attached, to carry out such an abandonment and file same in the Registrar of Deeds’ Office.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
