ORDINANCE NO. BL2000-264

An ordinance amending Section 11.12.060(A) of the Metropolitan Code of Laws relative to the prohibition of permitting prostitution, drunkenness, unlawful sale of alcoholic beverages, gambling, the sale, exhibition or possession of any obscene material or obscene conduct, fighting or loud noise.

Whereas, Section 11.12.060(A) of the Metropolitan Code of Laws prohibits an "owner, lessee or proprietor of any house" from allowing prostitution, drunkenness, unlawful sale of alcoholic beverages, gambling, the sale, exhibition or possession of any obscene material or obscene conduct, fighting or loud noise sufficient to constitute a public breach of the peace; and

Whereas, in order to protect the public health, welfare and safety such a prohibition should apply, as well, to any manager, agent or employee of such a business.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That Section 11.12.060 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting the words, "owner, lessee or proprietor", and substituting in lieu thereof the following: "person who manages or controls any building, room or enclosure, either as an owner, lessee, agent or employee"

Section 2: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
