ORDINANCE NO. BL2000-248

An ordinance approving an agreement between the Metropolitan Government and the Tennessee Valley Authority, the Nashville Electric Service and the Cumberland Museums, Inc., both relating to the installation of a small solar powered electricity generating facility at the Cumberland Museum and granting an easement.

WHEREAS, the Tennessee Valley Authority ("TVA") seeks to install a small solar powered electricity generating facility (the "Facility") on property (the "Property") belonging to the Metropolitan Government of Nashville and Davidson County and located near the Cumberland Science Museum; and

WHEREAS, installation of the Facility will provide the citizens of Davidson County with an educational opportunity to learn about solar power; and

WHEREAS. installation of the Facility will improve the balance among power sources in the Davidson County area; and

WHEREAS, the parties seek to memorialize their understandings in the agreement ("Agreement") attached as Exhibit 1 to this ordinance and in the easement ("Easement") attached as Exhibit 2 to this ordinance; and

WHEREAS, approval of the Agreement and the Easement will benefit the quality of life for citizens of Davidson County.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Mayor is hereby authorized to execute the Agreement attached as Exhibit 1.

SECTION 2: That the Director of Public Property is hereby authorized to execute the Agreement attached as Exhibit 1.

SECTION 4: That any amendments to the Agreement or the Easement must be approved by Resolution of the Metropolitan Council.

SECTION 5: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
