ORDINANCE NO. BL2000-208

An ordinance abandoning the sewer line and easement on Map 104-3, Parcel 259, (Proposal No. 99M-157U-10) of Project No. 99-SL-31, Vanderbilt University Consolidation Easement Abandonment, and authorizing the Metropolitan Mayor to execute the attached document.

WHEREAS, V. U. Real Estate Holdings, Inc. is the owner of real property encumbered by a sewer easement; and,

WHEREAS, V. U. Real Estate Holdings, Inc. has installed a new sewer line and dedicated an easement which adequately serves the lots and the neighboring properties; and,

WHEREAS, the sewer line and sewer easement is no longer being used by the Department of Water and Sewerage Services, more particularly described on the plans for Project No. 99-SL-31, Vanderbilt University Consolidation, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and,

WHEREAS, the Department of Water and Sewerage Services has no need for the said easement; and,

WHEREAS, The Metropolitan Planning Commission of Nashville and Davidson County has already approved the abandonment of said easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the sewer line and the sewer easement shown on Map 104-3, Parcel 259, is declared abandoned, and the Metropolitan Mayor is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
