ORDINANCE NO. BL2000-181

An ordinance authorizing the Metropolitan Government to participate with McEwen Development, LLC for the construction of Project No. 99-SL-82, Christianstead Valley on-site and off-site sewer project.

WHEREAS, McEwen Development, LLC has expressed a desire to provide public sewer system improvements to certain property at Holt Woods Section 13 in southeast Davidson County; and

WHEREAS, the Christianstead Valley On-site and Off-site sewer, Project No. 99-SL-82, will eliminate the Holt Woods sewage pumping station; and

WHEREAS, it is deemed in the best interest of the public to construct the sewer system improvements, and the Metropolitan Government is agreeable to paying an amount not to exceed $42,000 to McEwen Development, LLC in aid of the construction; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-SG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to execute the attached agreement, Exhibit 1, authorizing payment to McEwen Development, LLC in an amount not to exceed $42,000 to aid in the construction of the sewer improvements designated as Project No. 99-SL-82, to be paid from the Water and Sewer Replacement Fund and the Director of Metro Water Services is authorized to execute the agreement.

SECTION 2: That the payment authorized in Section 1 shall not be made until McEwen Development, LLC has executed a Deed of Conveyance for the improvements to the Metropolitan Government and proof of having released all mechanics and materialmans liens.

SECTION 3: That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
