ORDINANCE NO. BL2000-175

An ordinance amending Section 2.56.610 of the Metropolitan Code of Laws to provide that the collection of the pre-trial supervision fee be collected by the General Sessions Courts.

Whereas, on June 1, 1999, Ordinance No. O99-1658 (now Section 2.56.610 of the Metropolitan Code of Laws) was adopted by the Metropolitan County Council which provided for the imposition of a $35 pre-trial supervision fee to be paid by defendants in the Pre-Trial Release Program of the Metropolitan Government, which fee was to be collected by the Criminal Court Clerk; and

Whereas, it was estimated by the General Sessions Courts that approximately 450-500 persons each month are participating in the Pre-Trial Release Program and the supervision fee assists in offsetting the costs of operating said Program; and

Whereas, the General Sessions Courts believe that the fees collected will be improved if the fee is collected by the courts at the beginning of the supervision process rather than by the Criminal Court Clerk as a part of the court cost.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1: That Section 2.56.610 of the Metropolitan Code of Laws shall be and the same is hereby amended by deleting the sentence, "The said fee shall be added to the court cost and shall be collected by the criminal court clerk", and substituting in lieu thereof the following new sentence: "The said fee shall be collected by the general sessions court pre-trial release program."

Section 2: This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
