SUBSTITUTE ORDINANCE NO. SO99-1758

A substitute ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning Jr. Achievement Street located between 9th and 10th Avenues North, south of Church Street (Proposal No. 99M-078U), all of which is more particularly described herein.

WHEREAS: It is the desire of all the abutting property owners that said abandonment be accomplished; and,

WHEREAS: With the recording of an approved plat consolidating certain parcels, providing for the relocation of all necessary easements, and the dedication of a 40 foot public right-of-way for a new public street, "Lifeway Plaza", to contain a six foot sidewalk on each side of the street and two 12 foot travel lanes providing two-way traffic, where Alley #108 is presently located between 9th and 10th Avenues North, there is no future need for Jr. Achievement Street between 9th and 10th Avenues North; and

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1. That the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, as enacted by Ordinance No. O98-1473, be and is hereby amended, as follows:

That Jr. Achievement Street located between 9th and 10th Avenues North; all of which is more particularly described by lines, words and figures on the sketch which is attached to and made a part of this ordinance as though copied herein, are hereby closed.

SECTION 2. BE IT FURTHER ENACTED, THAT said street closure will not become effective until Lifeway Christian Resources of the Southern Baptist Convention records an approved plat consolidating parcels 7-10, 14, 16, 16.01 – 16.06, 47 on tax map 93-5-4 surrounding Jr. Achievement Street into one plat as identified on the attached sketch and on that plat showing the relocation and disposition of all utility easements presently located within the existing Jr. Achievement Street and the dedication of a 40 foot public right-of-way for a new public street, "Lifeway Plaza", to contain a six foot sidewalk on each side of the street and two 12 foot travel lanes providing two-way traffic, where Alley #108 is presently located between 9th and 10th Avenues North.

SECTION 3. BE IT FURTHER ENACTED, That the Director of the Department of Public Works be and is hereby authorized and directed, upon the enactment and approval of this ordinance, to cause said change to be made on said Map as set out in Section 1 of this ordinance, and to make notation thereon of reference to the date of passage and approval of this amendatory ordinance.

SECTION 4. BE IT FURTHER ENACTED, That this ordinance take effect immediately after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
