SUBSTITUTE ORDINANCE NO. SO98-1447

A substitute ordinance to amend Sections 1.01.030 and 12.84.030 of The Metropolitan Code of Laws to add sections to the list of designated titles to which the $500 penalty provision applies amending the penalty provision of sections 12.12.090, 12.12.110, 12.20.010, 12.20.020, 12.20.070 and 12.68.170.

Whereas, the Metropolitan Council of Nashville and Davidson County desires to keep roadways as safe as possible and minimize the number of accidents; and

Whereas, a driver’s failure to obey traffic laws dramatically increases the probability of an accident occurring; and

Whereas, increasing the amount of penalties will create a disincentive for drivers to break the law resulting in safer roads; and

Whereas, pursuant to TN Code Annotated 7-3-507, the Metropolitan government may assess penalties for municipal ordinance violations of up to five hundred dollars ($500) for each violation.

NOW, THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF NASHVILLE AND DAVIDSON COUNTY AS FOLLOWS:

Section 1: Section 1.01.030(B) of the Metropolitan Code is amended by adding the following to the list of designated titles to the sections to which the $500 maximum penalty applies:

12     12.24.040

12     12.68.170

Section 2: Section 12.12.090(F) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

F. Section 12.84.030 sets out the penalty for violation of Subsections (A)(1),(A)(2),(C)(1),(C)(2) and (D) of this section.

Section 3: Section 12.12.110(E) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

E. Section 12.84.030 sets out the penalty for violation of Subsection B, C and D of this section.

Section 4: Section 12.20.010(B) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

B. Section 12.84.030 sets out the penalty for violation of Subsection A of this section.

Section 5: Section 12.20.020 of the Metropolitan Code is amended by adding Subsection C as follows:

C. Section 12.84.030 sets out the penalty for violation of Subsection A and B of this section.

Section 6: Section 12.20.070 (B) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

B. Section 12.84.030 sets out the penalty for violation of Subsection A of this section.

Section 7: Section 12.24.040(D) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

D. Section 12.84.030 sets out the penalty for violation of Subsections B and C of this section.

Section 8: Section 12.68.170(B) of the Metropolitan Code is amended by deleting it in its entirety and replacing it with the following:

B. Section 12.84.030 sets out the penalty for violation of Subsection A of this section.

Section 9: Section 12.84.020 is amended by deleting the following and renumbering as necessary:

4. 12.12.090 (A)(1), (A)(2), (C)(1), (C)(2) and (D), Signal legend – Colors and other indications;

6. 12.12.110 (B) through (D), Traffic lanes;

31. 12.20.010, Basic Rule – Reasonable speed under the conditions;

35. 12.24.040 (B) and (C), Procedures for vehicles entering stop or yield intersections;

72. 12.68.170, Careless driving;

Section 10: Section 12.84.030(A) is amended by deleting it in its entirety and replacing it with the following:

The following violations may carry a penalty not to excess five hundred dollars:

1. 12.12.090, Signal Legend—Colors and other Indications;

2. 12.12.110, Traffic Lanes;

3. 12.20.010, Reasonable Speed under the conditions;

4. 12.20.020, Maximum Speed Limits;

5. 12.20.030, Special Speed Zones;

6. 12.20.070, School Zone Restrictions;

7. 12.24.040, Procedures for vehicles entering stop or yield intersections;

8. 12.68.030, Driving through funeral procession;

9. 12.68.110(A) and (B), Towing of Vehicles;

10. 12.68.130, Driving on sidewalks;

11. 12.68.150(A) through (C), Putting glass, nails or other injurious materials on highway—Clearing accident wreckage;

12. 12.68.170, Careless driving;

13. 12.68.180, Reckless driving;

14. 12.68.200 Attempting to elude police officers.

Section 11: This Ordinance shall take effect from and after the passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
