ORDINANCE NO. O99-1693

An ordinance authorizing the acquisition of property by negotiation or condemnation for use in a public project for The Metropolitan Government of Nashville and Davidson County and specifically with relation to the construction of a new facility for Bailey Middle School.

WHEREAS, Section 2.01 (5) of the Charter of The Metropolitan Government of Nashville and Davidson County grants to such government the power to "…purchase…or otherwise acquire…property…for any public purpose."; and

WHEREAS, Section 2.01 (6) of the Charter of The Metropolitan Government of Nashville and Davidson County authorizes the government "to establish, maintain and regulate…a system of free schools…"; and

WHEREAS, it is in the public interest that certain property be acquired through negotiation or condemnation for the purpose of acquiring land for a new facility for Bailey Middle School.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Director of Public Property Administration, or his designee, is hereby authorized to acquire by negotiation or condemnation property for the purpose of constructing, maintaining and operating a new facility for Bailey Middle School.

SECTION 2. The Director of Public Property Administration, or his designee, is hereby authorized and directed, if necessary, to take and appropriate by condemnation proceedings the property shown on Exhibit A and identified as Parcel 320 on Tax Map 83-2 and Parcel 91 on Tax Map 83-3.

SECTION 3. This Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
