ORDINANCE NO. O99-1583

An ordinance authorizing the Metropolitan Government to participate with Sassan for the construction of Project No. 97-SL-153A, Old Hickory Blvd. near Bell Road.

WHEREAS, Sassan has expressed a desire to provide public sewer system improvements to certain property in the Old Hickory Boulevard near Bell Road area; and

WHEREAS, it is deemed in the best interest of the public to construct the sewer system improvements, and the Metropolitan Government is agreeable to paying its proportionate share of the total cost in an amount not to exceed $40,000.00; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-SG-0001.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to pay to Sassan an amount not to exceed $40,000.00 to aid in the construction of the sewer improvements designated as Project No. 97-SL-153A, to be paid from the Water and Sewer Replacement Fund and the Director of Metro Water Services is authorized to execute the agreement, a copy attached.

SECTION 2: That the payment authorized in Section 1 shall not be made until Sassan has executed a Deed of Conveyance to the Metropolitan Government, releasing all mechanics and materialmans liens.

SECTION 3: That this Ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
