ORDINANCE NO. O99-1570

An ordinance to approved the granting of a permanent easement on certain property owned by the Metropolitan Government (Tax Map 70-15, Parcel 43) and used for The Looby Center.

WHEREAS, The Metropolitan Government of Nashville and Davidson County, Tennessee, owns certain property in Davidson County located on Metrocenter Boulevard (Tax Map 70-15, Parcel 43) and used for the Looby Center; and

WHEREAS, an adjacent property owner desires a permanent easement (as depicted on the attached Exhibit A) on a portion of said property for the purposes of connecting to a public sewer line; and

WHEREAS, the Board of Parks and Recreation has determined that the granting of this easement would not adversely affect the usage of said property; and

WHEREAS, the Department of Water & Sewerage Services has approved the establishment of this easement.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The granting of a permanent easement (as depicted on the attached Exhibit A) on Tax Map 70-15, Parcel 43, is hereby approved.

SECTION 2. The Director of Public Property Administration, with the recommendation of the Board of Parks and Recreation, is hereby directed to grant said easement and is authorized to execute the necessary documents pertaining thereto.

SECTION 3. This Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.
