ORDINANCE NO. O99-1559
An ordinance approving a ground lease agreement between the Tennessee Board of Regents and the Metropolitan Government for construction of a television studio at Nashville State Technical Institute for public, educational, and governmental programming.
Whereas, in 1995 the Metropolitan Council created the Public, Public and Governmental Access Oversight Committee (P.E.G.) in conjunction with the renewal of a cable television franchise with Viacom International, Inc., (Viacom); and
Whereas the P.E.G. is empowered by section 6.10.040 of the Metropolitan Code of Laws to facilitate the operation of television programming for public, educational and governmental uses; and
Whereas, the P.E.G. has determined and recommended that in order to adequately provide public, educational and governmental programming, a television studio controlled by the Metropolitan Government is badly needed; and
Whereas, funding for the television studio is available through a one-time payment of $500,000 as well as annual payments of $100,000 made by Viacom and now Intermedia as a condition of the renewal of the cable television franchise in 1995; and
Whereas, a ground lease agreement for space for a television studio at Nashville State Technical Institute has been negotiated with the Tennessee Board of Regents for the mutual benefit of the Metropolitan Government and the State of Tennessee.
Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County.
Section 1. That the Ground Lease Agreement between the Tennessee Board of Regents and The Metropolitan Government of Nashville and Davidson County for premises at Nashville State Technical Institute for use as a television studio for public, education and governmental programming for rent of one dollar ($1) per year and for a term commencing upon execution of this lease and extending through January 31, 2010, which lease is attached hereto by reference, is hereby approved and the Metropolitan Mayor is hereby authorized to execute said lease.
Section 2. That any amendment to the Ground Lease Agreement approved herein may be approved by resolution of the Metropolitan Council
Section 3. That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
