ORDINANCE NO. O99-1530

An ordinance amending section 2.44.030 of the Metropolitan Code authorizing the Chief of Police of the Metropolitan Police Department to enter into contracts with individual police recruits which will permit the Metropolitan Government to recoup some of the monetary expenditures used in training police recruits should the police recruit refuse employment with the Metropolitan Police Department or leave the Metropolitan Police Department in the first three years of the recruits employment.

Whereas, the Metropolitan Government of Nashville and Davidson County frequently needs to train police officers to fill vacated positions or to increase the size of the police force; and,

Whereas, the Metropolitan Government expends money and resources in training police recruits at the police academy and in having the recruit trained on the job by an experienced qualified police officer; and,

Whereas, some recruits take employment with other states or other governmental enforcement agencies upon graduation or during the initial three years of employment.

Whereas, it is to the benefit of the citizens of the Metropolitan Government of Nashville and Davidson County to recoup some of the funds expended in training recruits who did not accept employment with the Metropolitan Police Department or left the Metropolitan Police Department within three years of graduating from the police academy.

Now, therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson County:

Section 1. Section 2.44.030 be amended by adding a new subsection (C) which shall read as follows:

The Chief of Police of the Metropolitan Police Department is authorized to enter into contracts which would permit the Metropolitan Government to recoup funds expended in training recruits who did not accept employment with the Metropolitan Police Department or left the Metropolitan Police Department within three years of graduating from the police academy.

Section 2: The Chief of Police of the Metropolitan Police Department is only authorized to enter into contracts substantially similar to the attached contract, which is incorporated into this ordinance.

Section 3: Any significant changes or amendments to the attached contract

may be approved by resolution with two-thirds affirmative votes of the Metropolitan Council.

Section 4: That this ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
