ORDINANCE NO. O99-1509

An ordinance authorizing the Metropolitan Mayor to execute an agreement permitting the privately funded construction of an indoor tennis facility at the Sportsplex.

Whereas, the Metropolitan Government owns and operates the Sportsplex facility in order to provide sports and recreational opportunities to the citizens of Davidson County; and

Whereas, currently there is no indoor tennis facility at the Sportsplex; and

Whereas, Mr. L.D. Speyer has agreed to fund, and Holt-Southeast Corporation has agreed to construct, an indoor tennis facility at the Sportsplex pursuant to the tennis of the Agreement (the "Agreement") attached as Exhibit A and incorporated into this Ordinance by reference; and

Whereas, entry into the Agreement will benefit the citizens of Davidson County by enhancing the quality and availability of sports and recreational opportunities in Davidson County.

Now therefore, be it enacted by the Council of The Metropolitan Government of Nashville and Davidson county:

Section 1: That the Metropolitan Mayor is hereby authorized to execute the attached Agreement between The Metropolitan Government of Nashville and Davidson County, L.D. Speyer and Holt Southeast Corporation.

Section 2: That any amendments, renewals or extension of the terms of the Agreement must be approved by Resolution of the Metropolitan Council.

Section 3: That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Govemment of Nashville and Davidson County requiring it.
