ORDINANCE NO. O99-1501

An ordinance approving the abandonment of a portion of a sanitary sewer easement encumbering Parcel 21 on Tax Map 119-10 (Proposal No. 98M-133U).

WHEREAS, St. Edward Catholic Church is the owner of real property (tax map 119-10, parcel 21) encumbered on a portion of it by a 20’ x 160’ sanitary easement; and

WHEREAS, the public sanitary sewer line needs to be shortened to accommodate construction of a new building; and

WHEREAS, a private line will be extended from the shortened sanitary sewer line to serve the site; and

WHEREAS, no other public services will be affected by this abandonment.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1: That a 20’ x 160’ portion of a sanitary sewer easement of record in Deed Book 4729, page 209, R.O.D.C., Tennessee, and shown in exhibit A attached hereto is hereby abandoned.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
