ORDINANCE NO. O99-1500
An ordinance approving the abandonment of a drainage easement encumbering a portion of Parcel 36 on Tax Map 108 (Proposal No. 98M-132U).
WHEREAS, Duke Realty, L.P. is the owner of real property (tax map 108, parcel 36) encumbered by the 10’ x 200’ drainage easement; and
WHEREAS, the water currently discharged by the drainage easement will be redirected to another drainage easement; and
WHEREAS, the abandonment of the drainage easement and redirection of the water to another drainage system will have a positive effect on the development of the site; and
WHEREAS, no other services will be affected by this abandonment.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:
SECTION 1: That an easement located on Lot 6, Metro Airport Center, of record in Deed Book 3941, page 867, R.O.D.C., Tennessee, and shown in exhibit A attached hereto is hereby abandoned.
SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
