An ordinance abandoning a portion of sewer easement encumbering Lot 3 Whitworth Subdivison, Project Numbers 86-SS and 80-SC-87D, and authorizing the Director of Public Property to execute the necessary documents pertaining thereto. 

WHEREAS, Richland Place, Inc. is the owner of real property (Tax Map 104-14, Parcel 312) encumbered by sewer easements; and

WHEREAS, Richland Place Inc. has installed a new sewer line which adequately serves the lots and the neighboring properties; and

WHEREAS, easements to protect the integrity of the new sewer lines have been established by the recording of a plat in Plat Book 9700, Page 247, R.O.D.C., Tennessee; and

WHEREAS, a portion of the original easement, not of record, is no longer being used by the Department of Water and Sewerage Services; as shown on the plans for Project Nos. 86-SS and 80-SC-87D, more particularly described on the plans for Project No. 95-SL-165, on record in the office of the Director of Water and Sewerage Services, said plans are made a part hereof as though copied herein; and

WHEREAS, the Department of Water and Sewerage Services has no need for the said portion of easement; and

WHEREAS, The Metropolitan Planning Commission has approved the abandonment of said portion of easement through Proposal No. 98M-009U.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That a portion of the sewer easement not of record is declared abandoned, and the Director of Public Property is hereby authorized to execute the appropriate instruments to carry out such abandonment.

SECTION 2: That this ordinance take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
