WHEREAS, the Metropolitan Code of Laws § 10.20.260 and 10.20.330 regulate the disposal of solid waste from passenger cars and non-commercial, standard pickup trucks; and

WHEREAS, these ordinances have been challenged as illegal in a pending lawsuit; and

WHEREAS, it is in the best interests of the Metropolitan Government to amend these provisions.

NOW THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

Section 1. Metropolitan Code of Laws § 10.20.260 is deleted in its entirety.

Section 2. Metropolitan Code of Laws § 10.20.330 is deleted in its entirety and replaced with a new section 10.20.330 as follows:

A. Any person enjoying the privilege of providing temporary or permanent disposal of solid waste pursuant to this chapter shall accept waste from passenger cars disposing of such waste at no charge.

B. Any person enjoying the privilege of providing temporary or permanent disposal of solid waste pursuant to this chapter shall accept waste from private, non-commercial, standard pickup trucks at a fee not to exceed ten dollars per load.

C. In addition to the fees permitted in subsection (A) and (B), any person enjoying the privilege of providing temporary or permanent disposal of solid waste pursuant to this chapter may charge passenger cars or private, non-commercial standard pickup trucks the solid waste disposal fee authorized by Metropolitan Code of Laws § 10.20.287. Nothing in this section shall remove the obligation of any person enjoying the privilege of providing temporary or permanent disposal of solid waste pursuant to this chapter from remitting the appropriate solid waste disposal fee to the Metropolitan Government as established in Metropolitan Code of Laws § 10.20.287.

Section 3. That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
