ORDINANCE NO. O98-1293

AN ORDINANCE APPROVING AN EDWARD BYRNE MEMORIAL FORMULA GRANT PROGRAM CONTRACT WITH THE STATE OF TENNESSEE, DEPARTMENT OF FINANCE AND ADMINISTRATION, OFFICE OF CRIMINAL JUSTICE PROGRAMS, IN THE AMOUNT OF ONE HUNDRED THIRTY-SEVEN THOUSAND SIX HUNDRED EIGHTY-SEVEN DOLLARS ($137,687.00) PER YEAR FOR THREE YEARS FOR THE DISTRICT ATTORNEY GENERAL (GENERAL SESSIONS INTAKE PROGRAM).

WHEREAS, the State of Tennessee, Department of Finance and Administration, Office of Criminal Justice Programs, has awarded an Edward Byrne Memorial Formula Grant Program grant contract in an amount not to exceed four hundred thirteen thousand sixty-one dollars ($413,061.00), to be paid in annual increments of one hundred thirty-seven thousand six hundred eighty-seven dollars ($137,687.00) per year over a three year period, for the drug control and drug control systems improvement General Sessions Intake Program by the 20th Judicial District Attorney General; and,

WHEREAS, the Metropolitan Government is required under said grant contract to provide matching funds in the amount of forty-five thousand eight hundred ninety-six dollars ($45,896.00) per year; and,

WHEREAS, matching funds for the 1998-99 fiscal year have been appropriated to the 20th District Attorney General in Substitute Ordinance No. S098-1237; and,

WHEREAS, it is to the benefit of the citizens of The Metropolitan Government of Nashville and Davidson County that this grant be accepted;

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1 :That the grant contract between the State of Tennessee and The Metropolitan Government of Nashville and Davidson County for the drug control and drug control systems improvement General Sessions Intake Program (Grant Number 99DG077) by the 20th Judicial District Attorney General, from July 1, 1998, to June 30, 2001, a copy of which is attached hereto and incorporated herein, is hereby approved as including the requirement for annual cash match, and the Metropolitan Mayor is authorized to execute the same.

SECTION 2 :That amendments to the grant contract referenced herein shall be approved by resolution of the Metropolitan Council, by twenty-one affirmative votes.

SECTION 3 :That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
