ORDINANCE NO. O98-1286

AN ORDINANCE AUTHORIZING MCFARLIN WOODS, L.L.C. TO PARTICIPATE WITH THE METROPOLITAN GOVERNMENT FOR THE PLANNING, DESIGN AND CONSTRUCTION OF THE NOLENSVILLE TRUNK SEWER, PROJECT NO. 98-SG-13. THE METROPOLITAN GOVERNMENT AGREES TO ACCEPT AN AMOUNT NOT TO EXCEED $86,000.00 AS A CONTRIBUTION IN AID OF CONSTRUCTION BY THE SAID, MCFARLIN WOODS, L.L.C. (MCFARLIN WOODS SUBDIVISION).

WHEREAS, substitute Resolution Number R97-797 authorized the Metropolitan County Mayor to execute agreements between the Metropolitan Government of Nashville and Davidson County and other parties pertaining to the provision of sewer service in the Mill Creek drainage area; and

WHEREAS, McFarlin Woods, L.L.C has expressed a desire to provide public sewer service in the Nolensville Road - Countryside Road area in the city of Nolensville (Williamson County) to serve McFarlin Woods Subdivision, Sections one (Lot 115 ) two (Lots 212 through 228) and three (Lots 301 through 325); and

WHEREAS, it is deemed in the best interest of the public to provide sanitary sewerage service in a portion of Williamson County formerly serviced by or in a service area of Nolensville/College Grove Utility District, and McFarlin Woods, L.L.C. is agreeable to paying its share of the cost of the trunk sewer in the amount of $86,000.00.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1 : That the Metropolitan Government is hereby authorized to accept from McFarlin Woods, L.L.C. the amount of $86,000.00 in $2,000.00 per lot assessments at the time of connection as a contribution in aid of construction for improvements designated as Project No. 98-SG-13 (see attached map).

SECTION 2 : That this Ordinance shall take effect after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
