ORDINANCE NO. O98-1284

AN ORDINANCE AUTHORIZING THE METROPOLITAN GOVERNMENT TO PARTICIPATE WITH CBM ENTERPRISES, INC. FOR THE CONSTRUCTION OF PROJECT NO. 97-SG-139. THE METROPOLITAN GOVERNMENT AGREES TO PAY AN AMOUNT NOT TO EXCEED $347,150.00 AS A CONTRIBUTION IN AID OF CONSTRUCTION TO THE SAID, CBM ENTERPRISES, INC.

WHEREAS, CBM Enterprises, Inc. has expressed a desire to provide public sewer service in the Owl Creek drainage basin area of Brentwood to serve Magnolia Vale Subdivision; and

WHEREAS, it is deemed in the best interest of the public to construct the sewer service improvements, and the Metropolitan Government is agreeable to paying its proportionate share of the total cost in an amount not to exceed $347,150.00; and

WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-SG-0002.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the Metropolitan Government is hereby authorized to pay to CBM Enterprises, Inc. an amount not to exceed $347,150.00 to aid in the construction of the sewer improvements designated as Project No. 97-SG-139, to be paid from the Water and Sewer Extension and Replacement Fund.

SECTION 2: That the payment authorized in Section 1, shall not be made until CBM Enterprises, Inc. has executed a Deed of Conveyance (Project No. 97-SL-153) to the Metropolitan Government, releasing all mechanics and materialmans liens.

SECTION 3: That this Ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
