ORDINANCE NO. O98-1278

AN ORDINANCE APPROVING THE TRANSFER OF CERTAIN PROPERTY OWNED BY THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY TO THE METROPOLITAN DEVELOPMENT AND HOUSING AGENCY (MAP 93-6-4, PARCEL 62, 130 4TH AVE. S.).

WHEREAS, The Metropolitan Government of Nashville and Davidson County owns a certain parcel of property utilized by the Fire Department as a fire hall and maintenance facility; and,

WHEREAS, the Fire Department desires to relocate these services; and,

WHEREAS, the Metropolitan Development and Housing Agency desires to acquire said property for redevelopment purposes consistent with the goals and objectives of the Rutledge Hill Redevelopment Plan; and,

WHEREAS, the parcel of property must be designated by the Metropolitan Government as surplus property prior to relocating the existing facilities and redeveloping the site; and,

WHEREAS, any proceeds from a sale of the property by M.D.H.A. for redevelopment purposes will be used to relocate the existing fire hall facilities and for future property acquisition in the redevelopment area; and,

WHEREAS, the Director of Public Property Administration is authorized to transfer said property, subject to the approval of the Metropolitan County Council and Mayor.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, TENNESSEE:

SECTION 1. The Metropolitan Council declares the following parcel of land owned by the Metropolitan Government to be surplus:

130 4th Avenue South
Map 93-6-4, Parcel 62

SECTION 2. The Director of Public Property Administration is hereby authorized to transfer said property to the Metropolitan Development and Housing Agency and is hereby authorized to execute the necessary documents pertaining thereto.

SECTION 3. This ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County, Tennessee, requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. O98-1278

Mr. President:

I move to amend Ordinance No. O98-1278 by amending Section 2 thereof by adding the following provision:

"All proceeds from the sale of the property by MDHA for redevelopment purposes will be expended first to relocating the fire facilities of the Metropolitan Government, and any excess funds from such a sale, after allowing MDHA its reasonable expenses involved in the sale, shall be remitted to the Metropolitan Government General Fund."
