ORDINANCE NO. O98-1213
AN ORDINANCE AUTHORIZING THE METROPOLITAN GOVERNMENT TO PARTICIPATE WITH HAWKINS DEVELOPMENT COMPANY FOR THE CONSTRUCTION OF PROJECT NO. 97-WL-121. THE METROPOLITAN GOVERNMENT AGREES TO PAY AN AMOUNT NOT TO EXCEED $118,130.00 AS A CONTRIBUTION IN AID OF CONSTRUCTION TO THE SAID, HAWKINS DEVELOPMENT COMPANY.
WHEREAS, Hawkins Development Company has expressed a desire to provide public water system improvements to certain property in the Old Hickory Boulevard, Industrial Drive and Robinson Road areas; and
WHEREAS, it is deemed in the best interest of the public to construct the water facility improvements, and the Metropolitan Government is agreeable to paying its proportionate share of the total cost in an amount not to exceed $118,130.00; and
WHEREAS, this work is identified in METRO’S CAPITAL IMPROVEMENTS BUDGET as Project No. 96-SC-0001.
NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:
SECTION 1: That the Metropolitan Government is hereby authorized to pay to Hawkins Development Company an amount not to exceed $118,130.00 to aid in the construction of the water improvements designated as Project No. 97-WL-121, to be paid from the Water and Sewer Replacement Fund.
SECTION 2: That the payment authorized in Section 1, shall not be made until Hawkins Development Company has executed a Deed of Conveyance to the Metropolitan Government, releasing all mechanics and materialmans liens.
SECTION 3: That this Ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
