WHEREAS, T.C.A. § 49-2-202 provides that "the compensation of the county board [of education] shall be fixed by the county legislative body"; and

WHEREAS, the Metropolitan Charter is silent as to the compensation of members of the Metropolitan Board of Education; and

WHEREAS, the Metropolitan Council of Nashville and Davidson County believes that it is in the best interest of the public to compensate members of the Metropolitan Board of Education; the Metropolitan Council of Nashville and Davidson County desires to amend the Metropolitan Code of Laws of the Metropolitan Government of Nashville and Davidson County to compensate members of the Metropolitan Board of Education.

NOW THEREFORE, BE IT ENACTED BY THE METROPOLITAN COUNCIL OF NASHVILLE AND DAVIDSON COUNTY AS FOLLOWS:

SECTION 1. Title 2 Division III of the Metropolitan Code of Nashville and Davidson County is amended by adding Title 2, Chapter 2.101, Section 2.101.010

METROPOLITAN BOARD OF EDUCATION

2.101.010 Compensation of Members

Members of the Metropolitan Board of Education, duly elected pursuant to Section 9.02 of the Metropolitan Charter, shall be compensated at the same rate and according to the same terms and conditions as the Metropolitan County Council, as provided for in the General Pay Plan; provided, that the Metropolitan Trustee shall pay no voucher issued to members unless the same shall have been approved by the Metropolitan Mayor.

SECTION 2. This provision shall become effective on September 1, 1998 for members representing Districts 2, 4, 6, and 8, and September 1, 2000 for members representing Districts 1, 3, 5, 7, and 9. It is the intent of the Metropolitan Council that the compensation of each member shall remain constant throughout their term of office.

SECTION 3. This Ordinance shall take effect after its passage at the time specified above, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.

AMENDMENT NO. 1

TO

ORDINANCE NO. O98-1119

Mr. President:

I move to amend Ordinance No. O98-1119 by amending Ordinance No. O98-1119 by amending Section 1 thereof by deleting the following provision:

"Members of the Metropolitan Board of Education, duly elected pursuant to Section 9.02 of the Metropolitan Charter, shall be compensated at the same rate and according to the same terms and conditions as the Metropolitan County Council, as provided for in the General Pay Plan; provided, that the Metropolitan Trustee shall pay no voucher issued to members unless the sale shall have been approved by the Metropolitan Mayor."

and substituting in lieu thereof the following new provision:

"Members of the Metropolitan Board of Public Education, duly elected pursuant to Section 9.02 of the Metropolitan Charter, shall be compensated at the rate established and provided for in the General Pay Plan."
