ORDINANCE NO. O98-1053

AN ORDINANCE APPROVING AN AGREEMENT BY AND BETWEEN THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY, ACTING THROUGH THE METROPOLITAN POLICE DEPARTMENT AND THE TENNESSEE WALKING HORSE BREEDERS' AND EXHIBITORS' ASSOCIATION FOR THE DONATION OF SIX TENNESSEE WALKING HORSES FOR THE HORSE MOUNTED PATROL UNIT.

WHEREAS, the Tennessee Walking Horse Breeders' and Exhibitors' Association ("Association") desires to assist in establishing a Metropolitan Police Department Horse Mounted Patrol Unit; and

WHEREAS, the Association has committed to the Metropolitan Police Department a donation of six (6) Tennessee Walking Horses along with equipment to accomplish this endeavor; and

WHEREAS, the Metropolitan Police Department and the Association have entered into an agreement for the donation of the six (6) Tennessee Walking Horses; and

WHEREAS, it is deemed to be in the best interest of the Metropolitan Government to approve said Agreement,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That the agreement between The Metropolitan Government of Nashville and Davidson County, acting through the Metropolitan Police Department and the Tennessee Walking Horse Breeders' and Exhibitors' Association ("Association") in which the Association will donate six (6) Tennessee Walking Horses along with equipment to assist in establishing a Horse Mounted Patrol Unit, a copy of which is attached hereto, is hereby approved and the Metropolitan Mayor is authorized to execute the same.

SECTION 2: That any amendments to this Agreement shall be approved by resolution of the Metropolitan Council which receives at least twenty-one affirmative votes.

SECTION 3: That this Ordinance shall take effect from and after its passage, the welfare of the Metropolitan Government of Nashville and Davidson County requiring it.
