ORDINANCE NO. O97-1052

AN ORDINANCE APPROVING AN AMENDMENT TO AN AGREEMENT BY AND BETWEEN MADISON SUBURBAN UTILITY DISTRICT AND THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY FOR BILLING AND COLLECTION OF SEWER SERVICE WHICH AMENDMENT MODIFIES THE PAYMENT TERM.

WHEREAS, the Quarterly County Court of Davidson County, by Resolution, entered into an Agreement dated June 28, 1962, whereby Madison Suburban Utility District agreed to provide billing and collection services for sewer customers of the Metropolitan Government Department of Water Services; and

WHEREAS, the Metropolitan Government has paid, as a fee for such service, a percentage of the revenue collected, and desires that this payment be phased out and that a flat rate per bill per month be charged; and

WHEREAS, the Metropolitan Council deems such an amendment to be in the best interest of the Metropolitan Government.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1:That the Amendment to the Agreement entered into between the Metropolitan Government of Nashville and Davidson County and the Madison Suburban Utility District be amended by deleting paragraph 10. and replacing it with a new paragraph 10., which phases out the payment based on a percentage of revenue received and provides for a flat rate of $2.06 per bill per month, adjusted by the percentage increase in the CPI from May 1, 1996, a copy of which is attached hereto and incorporated herein, is hereby approved, and the Metropolitan County Mayor is authorized to execute the same.

SECTION 2:That this Ordinance shall take effect from and after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
