ORDINANCE NO. O98-1048

AN ORDINANCE AMENDING TITLE 15, CHAPTER 12, OF THE METROPOLITAN CODE OF LAWS ADDING A SUBSECTION "C" TO PROVIDE FOR FINES COLLECTED IN GENERAL SESSIONS COURT TO BE DEPOSITED INTO THE DEPARTMENT OF WATER & SEWERAGE SERVICES’ WATER AND SEWER REVENUE FUND ACCOUNT.

WHEREAS, the Department of Water and Sewerage Services, is a revenue-based department and under the current title cannot recover the cost of fines issued for violation of the Code; and

WHEREAS, the violations have, in most cases, resulted for loss of revenue or to recover expenses incurred by the Department; and

WHEREAS, it is necessary to amend Section 15.12.240 of The Metropolitan Code of Laws to allow fines to be deposited into the Department of Water and Sewerage Services Revenue Fund Account.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY:

SECTION 1: That Section 15.12.240 is amended by adding, Sub-Section "C. Any fine imposed for a violation of Chapter 15.04 through 15.60 shall be deposited into the Revenue Fund Account of The Department of Water and Sewerage Services."

SECTION 2: That this Ordinance shall take effect from and after its adoption, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
