AN ORDINANCE AUTHORIZING THE METROPOLITAN GOVERNMENT TO PARTICIPATE WITH WEXFORD DOWNS, LLC FOR THE CONSTRUCTION OF PROJECT NO. 95-SL-142 (WEXFORD DOWNS RESIDENTIAL P.U.D., 0FF-SITE SEWER CONSTRUCTION). THE METROPOLITAN GOVERNMENT AGREES TO PAY AN AMOUNT NOT TO EXCEED $115,000.00 AS A CONTRIBUTION IN AID OF CONSTRUCTION TO THE SAID, WEXFORD DOWNS, LLC.

WHEREAS, Wexford Downs, LLC has expressed a desire to provide public sewer service to certain property in the Edmonson Pike/Holt Road area; and,

WHEREAS, Wexford Downs, LLC has proposed to provide said sewer service with the construction of a sewage pumping station and a force main extending to an existing public sewer; and,

WHEREAS, The Metropolitan Government desires to have a gravity sewer installed in lieu of a portion of the proposed force main; and,

WHEREAS, it is deemed in the best interest of the public for construction of the gravity sewer system improvements, and The Metropolitan Government is agreeable to paying the additional cost incurred for a gravity sewer in lieu of a portion of the force main in an amount not to exceed $115,000.00,

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. the Metropolitan Government is hereby authorized to pay to Wexford Downs, LLC an amount not to exceed $115,000.00 to aid in the construction of the sewer system improvements designated as Project No. 95-SL-142 to be paid from the Water and Sewer Replacement Fund.

SECTION 2. The payment authorized in Section 1 shall not be made until Wexford Downs, LLC has executed a Deed of Conveyance releasing all mechanics and materialmans liens.

SECTION 3. That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
