AN ORDINANCE AUTHORIZING NASHVILLE AND EASTERN RAILROAD CORPORATION TO PARTICIPATE WITH THE METROPOLITAN GOVERNMENT FOR THE CONSTRUCTION OF PROJECT NO. 96-SG-144. THE METROPOLITAN GOVERNMENT AGREES TO ACCEPT AN AMOUNT NOT TO EXCEED $10,500.00 AS A CONTRIBUTION IN AID OF CONSTRUCTION FROM THE SAID, NASHVILLE AND EASTERN RAILROAD CORPORATION.

WHEREAS, Nashville and Eastern Railroad Corporation is planning railroad construction improvements in the vicinity of Stoners Drive which will require the relocation and replacement of certain public sewer facilities; and,

WHEREAS, it is deemed in the best interest of the public to construct the sewer facility improvements, and Nashville and Eastern Railroad Corporation is agreeable to paying their proportionate share of the total cost in an amount not to exceed $10,500.00.

NOW, THEREFORE, BE IT ENACTED BY THE COUNCIL OF THE METROPOLITAN GOVERNMENT OF NASHVILLE AND DAVIDSON COUNTY.

SECTION 1. That the Metropolitan Government is hereby authorized to receive from Nashville and Eastern Railroad Corporation an amount not to exceed $10,500.00 to aid in the construction of the sewer improvements designated as Project No. 96-SG-144. The participation is in accordance with the attached agreement between the Department of Water and Sewerage Services and Nashville and Eastern Railroad Corporation, copy attached as Exhibit A.

SECTION 2 That this ordinance shall take effect after its passage, the welfare of The Metropolitan Government of Nashville and Davidson County requiring it.
