Call to Order and Invocation

The Metropolitan Council met in regular session on this date at 6:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Council Member Larry Hagar.

Pledge of Allegiance

The Metropolitan Council gave the pledge of allegiance to the American Flag.

Consent Agenda Resolutions

Resolution RS2018-1040

A resolution approving Amendment Eleven to a grant from the State of Tennessee, Tennessee Emergency Management Agency, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Finance, to provide public assistance pursuant to Presidential Disaster Declaration number FEMA-1909-DR-TN to complete repairs and/or replacement to facilities damaged during April and May 2010.

The resolution was approved by the Budget and Finance Committee.

Resolution RS2018-1041

A resolution accepting a grant from the State of Tennessee, Department of Children’s Services, to The Metropolitan Government of Nashville and Davidson County, acting by and through the Davidson County Juvenile Court, for a Safe Baby Court to serve at risk children.

The resolution was approved by the Budget and Finance Committee.

Resolution RS2018-1042

A resolution authorizing the Metropolitan Department of Law to compromise and settle the personal injury claim of Kenya Lovell against the Metropolitan Government of Nashville and Davidson County in the amount of $45,000.00, and that said amount be paid out of the Self-Insured Liability Fund.

The resolution was approved by the Budget and Finance Committee.

Resolution RS2018-1043

A resolution authorizing the Metropolitan Department of Law to compromise and settle the claims of Amy Ramsey and Nick Ramsey against the Metropolitan Government of Nashville and Davidson County in the amount of $25,000.00, and that said amount be paid out of the Self-Insured Liability Fund.

The resolution was approved by the Budget and Finance Committee.

Resolution RS2018-1044

A resolution authorizing the Metropolitan Department of Law to compromise and settle the property damage claim of Brett Sweet against the Metropolitan Government of Nashville and Davidson County in the amount of $22,688.50, and that said amount be paid out of the Self-Insured Liability Fund.

The resolution was approved by the Budget and Finance Committee.

Resolution RS2018-1045

A resolution approving Amendment One to a grant from the Tennessee Housing Development Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Action Commission, for Low Income Home Energy Assistance Program (LIHEAP) services targeted toward the elderly, disabled, veterans, and households with children under the age of six years.

The resolution was approved by the Budget and Finance Committee and the Health, Hospitals, and Social Services Committee.

Resolution RS2018-1046

A resolution approving Amendment Four to a contract with Vanderbilt University Medical Center and The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to participate as a member site in the Centers for Disease Control Tuberculosis Epidemiologic Studies Consortium studies.

The resolution was approved by the Budget and Finance Committee and the Health, Hospitals, and Social Services Committee.

Resolution RS2018-1047

A resolution approving Amendments Eight and Nine to a grant from the U.S. Environmental Protection Agency to The Metropolitan Government of Nashville and Davidson County, acting by and through the Metropolitan Board of Health, to fund an ongoing program to protect air quality to achieve established ambient air standards and protect human health.

The resolution was approved by the Budget and Finance Committee and the Health, Hospitals, and Social Services Committee.

Resolution RS2018-1050

A resolution authorizing The Metropolitan Government of Nashville and Davidson County, acting by and through the Department of Water and Sewerage Services, hereinafter called the “Licensee,” to enter into a Facility Encroachment Agreement with CSX TRANSPORTATION, INC. hereinafter called “Licensor” to construct and maintain water lines in the railroad right-of-way north of the intersection of Bell Road and Collins Park Drive (Project No. 15WG0106).

The resolution was approved by the Budget and Finance Committee and the Public Works Committee.

Resolution RS2018-1051

A resolution authorizing Castlerock Asset Management to construct and install an aerial encroachment at 230 4th Avenue North for (Proposal No. 2018M-001EN-001).

The resolution was approved by the Planning Commission and approved by the Planning, Zoning, and Historical Committee and the Public Works Committee.

Resolution RS2018-1052

A resolution authorizing Belcourt Partners to construct and install aerial encroachments at 1911 Belcourt Avenue (Proposal No. 2018M-005EN-001).

The resolution was approved by the Planning Commission and approved by the Planning, Zoning, and Historical Committee and the Public Works Committee.

Resolution RS2018-1053

A resolution recognizing and welcoming the Most Reverend J. Mark Spalding as the 12th Bishop of the Diocese of Nashville.

The resolution was approved by the Rules,Confirmations, and Public Elections Committee.

Resolutions

Resolution RS2018-1048

A resolution accepting a grant from Boulevard Bolt, Inc. to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission to benefit the How’s Nashville program to aid homelessness.

The resolution was approved by the Budget and Finance Committee deferred by the Health, Hospitals, and Social Services Committee. The resolution was deferred pursuant to Rule 24.

Resolution RS2018-1049

A resolution accepting a grant from the Dorothy Cate and Thomas F. Frist Foundation to The Metropolitan Government of Nashville and Davidson County for the use and benefit of the Metropolitan Nashville Social Services Commission in support of the How’s Nashville Fund.

The resolution was approved by the Budget and Finance Committee and deferred by the Health, Hospitals, and Social Services Committee.   The resolution was deferred pursuant to Rule 24.

Resolution RS2018-1055

A resolution aimed at addressing and ending homelessness among students that attend Metropolitan Nashville Public Schools.

The resolution was approved by the Education Committee and the Health, Hospitals, and Social Services Committee. Council Member Shulman moved to defer the resolution, which motion was seconded and approved by voice vote of the Council.

Resolution RS2018-1056

A resolution approving an application for an Improving Criminal Justice Response to Sexual Assault, Domestic and Dating Violence, and Stalking Grant from the U. S. Department of Justice to The Metropolitan Government of Nashville and Davidson County, acting by and through the Office of Family Safety, to maintain and enhance current programming in response to victims of domestic and dating violence, stalking, and trafficking.

Substitute Bill BL2017-1027

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to RS10 zoning on properties located at 12474 and 12478 Old Hickory Boulevard, approximately 610 feet northeast of Murfreesboro Pike (21.36 acres), all of which is described herein (Proposal No. 2016Z-087PR-001).

Bill BL2018-1063 (as amended)

An ordinance amending Chapter 4.46 of the Metropolitan Code of Laws to require the Procurement Division to collect comprehensive data regarding the participation of subcontractors in the procurement process.

The bill was approved with amendments by the Budget and Finance Committee. Council Member Vercher offered Amendment No. 1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council.

Council Member Vercher moved to pass the bill on second reading as amended, which motion was seconded and approved by a voice vote of the Council.

Bill BL2018-1064

An ordinance authorizing the acquisition of an interest in a parcel of real property and the granting of an easement in that same parcel in connection with the development of the Nashville Yards project in downtown Nashville (Proposal No. 2018M-006PR-001).

An ordinance authorizing The Metropolitan Government of Nashville and Davidson County to negotiate and accept permanent and temporary easements for the Avery Green Court Stormwater Improvement Project for 15 properties located along Pitts Avenue, Donoho Drive, Avery Green Court, Stone Hodge Drive and Rifle Range Road (Project No. 18-SWC-127 and Proposal No. 2018M-003ES-001).
