Metropolitan Council Meeting
Tuesday, June 8, 2010


The Metropolitan Council met in special session on this date at 6:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Reverend Delores Nicholson of Christ Church Cathedral.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Tygard, Steine, Maynard, Harrison, Hunt, Craddock, Hollin, Jameson, Cole, Bennett, Forkum, Jernigan, Gotto, Stanley, Claiborne, Page, LaLonde, Gilmore, Langster, Crafton, Evans, Holleman, McGuire, Foster, Dominy, Wilhoite, Toler, Coleman, Duvall, Todd, Mitchell and Neighbors (32); Absent: Garrett, Barry, Matthews, Ryman, Burch, Moore, Baker, Adkins, Hodge (9).

The Minutes of the regular meeting of June 1, 2010, were approved.

Ladies and Gentlemen:

I am calling a Special Meeting of the Council pursuant to Section 3.04 of the Charter of the Metropolitan Government of Nashville and Davidson County to be held on Tuesday, June 8, 2010, at 6:00 p.m. for the purpose of considering the public hearing items that were to be on the agenda for the cancelled May 4, 2010, agenda. The following bills are to be advertised and considered for public hearing and second reading:

- BILLS ON PUBLIC HEARING -

BILL NO. BL2010-636

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, to add the land use “Historic Bed and Breakfast Homestay” as a special exception (SE) and a use permitted by right (P) rather than a classification of the historic overlay districts, all of which is more particularly described herein (Proposal No. 2010Z-006TX-001). The bill was approved by the Planning Commission. Ms. LaLonde moved to defer the bill indefinitely, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-647

An ordinance amending Chapters 17.08 and 17.16 of Title 17 of the Metropolitan Code, Zoning Regulations, to designate “manufacturing, medium” as a used permitted with conditions, all of which is more specifically described herein (Proposal No. 2010-009TX-001). The bill was approved by the Planning Commission. Mr. Jernigan requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Jernigan moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-648

An ordinance amending Section 17.16.250 of Title 17 of the Metropolitan Code, Zoning Regulations, to allow inflatable advertising figures in commercial districts (Proposal No. 2010-008TX-001). The bill was approved by the Planning Commission. Mr. Jernigan requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Jernigan moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-659

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from R6 to CS zoning for properties located at 336 Vivelle Avenue and Vivelle Avenue (unnumbered), approximately 195 feet east of Nolensville Pike (0.34 acres), all of which is described herein (Proposal No. 2010Z-009PR-001). The bill was disapproved by the Planning Commission. Ms Page requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Page moved to pass the bill on second reading and defer the bill to the first meeting in August, the bill being requested by STS Property Group, LLC, which motion was seconded and adopted by a voice vote of the Council with Mr. Coleman abstaining.

BILL NO. BL2010-661

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS15 to SP zoning for property located at 4130 Andrew Jackson Parkway, approximately 950 feet north of Chandler Road (2.04 acres), to permit an existing single-family dwelling unit to be used as a medical office with a maximum floor area of 2,700 square feet, to make all standards of MUN zoning applicable except no pawn shops permitted and no pole signs, only monument style or building mounted signs allowed, all of which is described herein (Proposal No. 2010SP-005-001). The bill was approved by the Planning Commission. Mr. Gotto requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Gotto moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-663

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from AR2a to SP zoning for properties located at 6887 and 6891 Burkitt Road and at Kidd Road (unnumbered), approximately 6,250 feet east of Nolensville Pike (91.67 acres), to permit 374 single-family lots, all of which is described herein (Proposal No. 2009SP-031-001). The bill was approved by the Planning Commission. Mr. Toler requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Toler moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-664

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from OR20 and IWD to SP zoning for properties located at 401, 403, 405, and 407 Veritas Street and a portion of property located at 410 Allied Drive, approximately 160 feet west of Nolensville Pike (1.06 acres), to permit a one-story, office and warehouse addition to an existing warehouse facility located at 410 Allied Drive, all of which is described herein (Proposal No. 2009SP-015-001). The bill was approved by the Planning Commission. Ms. Page requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. Page moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-666

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from MUG to MUI zoning for a portion of property located at 2415 Vanderbilt Place known as the General Library at Vanderbilt University approximately 1,400 feet south of West End Avenue (4.82 acres), all of which is described herein (Proposal No. 2010Z-001PR-001). The bill was approved by the Planning Commission. Ms. LaLonde requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Ms. LaLonde moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-668

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS10 to ON zoning for property located at 2898 Elm Hill Pike, at the northwest corner of Elm Hill Pike and Colfax Drive (0.35 acres), all of which is described herein (Proposal No. 2010Z-006PR-001). The bill was approved by the Planning Commission. Mr. Stanley requested a hearing from the public on this bill which had been previously advertised. An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS40 to CL zoning (6.76 acres) and from RS40 to CS zoning (0.03 acres) for property located at 8059 Highway 100, approximately 750 feet west of Temple Road, all of which is described herein (Proposal No. 2010Z-004PR-001). The bill was approved by the Planning Commission. Mr. Mitchell requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. Mitchell moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2010-675

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RM20 to SP zoning for property located within the Green Hills Urban Design Overlay District at 2209 Abbott Martin Road, at the southwest corner of Abbott Martin Road and Hillsboro Circle (2.08 acres), for multi-family, restaurant, cellular communications tower, and personal care service uses, all of which is described herein (Proposal No. 2010SP-003-001). The bill was approved by the Planning Commission. Mr. McGuire requested a hearing from the public on this bill which had been previously advertised. The President asked if anyone desired to be heard for or against the bill and no one came forward to be heard. The President declared the public hearing closed. Mr. McGuire moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.
