Metropolitan Council Meeting
Tuesday, March 3, 2009


The Metropolitan Council met in special session on this date at 4:30 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Tim Garrett.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Garrett, Barry, Tygard, Steine, Maynard, Matthews, Harrison, Hunt, Craddock, Murray, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, Gilmore, Baker, Langster, Crafton, Evans, Holleman, McGuire, Foster, Dominy, Wilhoite, Hodge, Toler, Coleman, Duvall, Todd, Mitchell and President Neighbors (39); Absent: Adkins (1).

RE: Special Meeting of the Metropolitan Council

Dear Vice Mayor and Members of the Metropolitan Council:

Pursuant to Section 3.04 of the Metropolitan Charter, and in consultation with Vice Mayor Neighbors, I am calling a special meeting of the Metropolitan Council at 4:30 PM on Tuesday, March 3, 2009.

The purpose of this meeting is to consider on second reading Bill No. BL2009-407 pertaining to issues amending various sections of the Metropolitan Code primarily dealing with water and sewer rates and establishing a stormwater fee.

In addition, we have discussed with Metro Council Members Jim Forkum, chair of the Budget & Finance Committee, and Parker Toler, chair of the Public Works Committee, calling a joint special committee session on March 2, 2009 for the purpose of discussing the above-referenced ordinance. Representatives of the Administration will be in attendance to answer any questions Council members may have.

While I always hesitate to call a special meeting, I believe it is imperative that we move forward on this important issue for our community as well as providing as much time as possible for our residents and businesses to prepare for the adjusted rates.

- BILL ON SECOND READING -

BILL NO. BL2009-407

An ordinance amending Sections 15.20.045(A), 15.20.050, 15.32.020, 15.32.190(B), 15.36.040(A), 15.36.070, 15.44.020, 15.64.010, 15.64.015, 15.64.020, 15.64.031, 15.64.032 and 15.64.033 of the Metropolitan Code of Laws. Mr. Forkum offered a substitute bill and moved that it be accepted for filing.

SUBSTITUTE BILL NO. BL2009-407

An ordinance amending Sections 15.20.045(A), 15.20.050, 15.32.020, 15.32.190(B), 15.36.040(A), 15.36.070, 15.44.020, 15.64.010, 15.64.015, 15.64.020, 15.64.031, 15.64.032 and 15.64.033 of the Metropolitan Code of Laws. The substitute bill was approved by the Budget and Finance and Public Works Committees; an amendment to the substitute bill was disapproved by the Budget and Finance Committee and approved by the Public Works Committee.

Mr. Holleman moved offered Amendment No. 1 and moved for its adoption, which motion was seconded. Mr. Ryman moved to table the motion to amend, which motion was seconded and failed by a roll call vote of the Council. The matter recurred on the motion to amend, which motion failed by a roll call vote of the Council.

The matter recurred on the motion to accept the substitute bill, which motion was seconded and adopted by the following vote: “Ayes” Garrett, Barry, Tygard, Steine, Maynard, Matthews, Harrison, Hunt, Craddock, Murray, Jameson, Cole, Bennett, Forkum, Ryman, Jernigan, Gotto, Burch, Stanley, Claiborne, Page, Moore, Gilmore, Baker, Langster, Evans, McGuire, Foster, Dominy, Wilhoite, Hodge, Toler, Coleman, Duvall, Todd, Mitchell (36); “Noes” Crafton, Holleman (2).

Mr. Forkum moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

Upon motion duly seconded, the meeting was adjourned.
