Metropolitan Council Meeting
Tuesday, August 7, 2007


The Metropolitan Council met in regular session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Jim Gotto.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The Minutes of the regular meeting July 17, 2007, were approved.

- ELECTIONS AND CONFIRMATIONS -

Auditorium Commission
Appointment of Mr. Pat Miller for a term expiring June 20, 2010. Without objection, the nomination was withdrawn.

Charter Revision Commission
Appointment of Mr. Bill Covington for a term expiring September 4, 2010. Mr. Covington will fill the unexpired term of Mr. Jay West. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Employee Benefit Board
Appointment of Dr. Christine Bradley for a term expiring June 30, 2009. Dr. Bradley will fill the unexpired term of Mr. Gary Dowdy. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Board of Health
Reappointment of Dr. Henry Foster for a term expiring July 9, 2012. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Human Relations Commission
Reappointment of Rev. Kenneth Swanson for a term expiring April 18, 2010. The Rules-Confirmations-Public Elections Committee recommended the reappointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Tourism and Convention Commission
Appointment of Mr. Mike Modi for a term expiring June 30, 2010. Mr. Modi will serve as the Hotel/Motel Industry representative. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Transportation and Licensing Commission
Appointment of Ms. Jennifer Brundige for a term expiring October 10, 2008. Ms. Brundige will fill the unexpired term of Ms. Holly Sharp. The Rules-Confirmations-Public Elections Committee recommended the appointment and Ms. Neighbors moved for confirmation, which motion was seconded and adopted by a unanimous vote of the Council.

Industrial Development Board
The President called for nominations for fill one (1) vacancy on the Industrial Development Board of The Metropolitan Government of Nashville and Davidson County. Mr. Craddock nominated Mr. Floyd Shechter; Mr. White nominated Mr. John C. Hobbs, Jr.; Mr. Wallace nominated Ms. Freda Player. There being no further nominations, Mr. Loring moved that nominations be closed, which motion was seconded and adopted by a voice vote of the Council. The nominees were referred to the Rules-Confirmations-Public Elections Committee for a recommendation, and an election will be conducted at the next regular meeting of the Council.

Metropolitan Auditor
The President announced that the Council will appoint a Metropolitan Auditor at the next regular meeting of the Council from three candidates recommended by the Audit Committee.

- BILL ON PUBLIC HEARING –

BILL NO. BL2007-1567

An ordinance approving the Skyline Redevelopment Plan. The bill was approved by the Planning Commission and Federal Grants Review Committee. Ms. Murray moved to defer the bill indefinitely so that affected merchants could have additional time to review the options presented, which motion was seconded and adopted by a voice vote of the Council.

A resolution accepting a grant from the National Center for Civic Innovation to The Metropolitan Government of Nashville and Davidson County. BILL NO. BL2005-637

An ordinance amending Section 12.40.040 of the Metropolitan Code by permitting parking within the Central Business Improvement District during certain evenings in some spaces where parking is now prohibited. The bill was disapproved by the Traffic and Parking Commission; the Traffic and Parking Committee recommended withdrawal. Mr. Wallace moved to withdraw the bill, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2005-651

An ordinance amending Section 12.08.150 of the Metropolitan Code by reducing the authority to tow vehicles illegally parked within the area of Metropolitan Government. The bill was approved by the Public Safety-Beer and Regulated Beverages Committee with an amendment. Mr. Wallace offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Wallace moved to pass the bill on second reading as amended, which motion was seconded and adopted by a voice vote of the Council.

SUBSTITUTE BILL NO. BL2006-1110

An ordinance to amend Title 17 of the Metropolitan Code of Laws, the Zoning Ordinance of The Metropolitan Government of Nashville and Davidson County, by changing from RS7.5, R15 and R20 to SP district, properties along the south side of Kirtland Avenue, and both sides of Farrar Avenue, Hood Avenue, and Castleman Drive between Hillsboro Pike and Lone Oak Road (51.66 acres), to prohibit new duplexes and permit property owners with 45,000 square feet lots or parcels at the time of adoption of the SP to subdivide into up to three lots each, and apply basic development standards, all of which is described herein (Proposal No. 2005SP-119U-10). The bill was approved by the Planning Commission and the Planning, Zoning and Historical Committee. Mr. Shulman moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council with Mr. Greer voting “No.”

BILL NO. BL2006-1250

An ordinance to amend the Official Street and Alley Acceptance and Maintenance Map for The Metropolitan Government of Nashville and Davidson County, by abandoning the right-of-way for Ridgefield Court (Proposal No. 2006M-089U-10). The bill was approved by the Planning Commission, Traffic and Parking Commission, Public Works Traffic and Parking, and Planning, Zoning and Historical Committees. Mr. Summers moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending Section 6.80.550 of the Metropolitan Code to eliminate the $200.00 storage fee for items stored at the Police Department Impound Lot, except for those items that are seized by the Police Department as a result of suspected criminal activity. The bill was approved by the Budget and Finance Committee and disapproved by the Public Safety-Beer and Regulated Beverages Committee. Mr. Wallace offered Amendment No.1 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Wallace moved to pass the bill on second reading as amended, which motion was seconded. BILL NO. BL2007-1449

An ordinance amending Section 17.36.070 of Title 17 of the Metropolitan Code, Zoning Regulations, to require developers clustering single-family and two-family lots within a planned unit development (PUD) district to construct recreational facilities on a portion of the designated common open space, all of which is more specifically described herein (Proposal No. 2007Z-071T). The bill was disapproved by the Planning Commission and approved by the Planning, Zoning and Historical Committee. Mr. Hunt moved to pass the bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

BILL NO. BL2007-1451

An ordinance amending Chapter 5.04 of the Metropolitan Code to require that nonprofit organizations receiving funds from the Metropolitan Government make meetings of their boards of directors open to the public. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Summers offered Amendment No. 2 and moved for its adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Summers moved to pass the bill on second reading as amended, which motion was seconded. An ordinance amending Chapter 6.80 of the Metropolitan Code pertaining to the “booting” of vehicles within the area of the Metropolitan Government. Mr. Dread moved to pass the substitute bill on second reading, which motion was seconded and adopted by a voice vote of the Council.

An ordinance amending Section 7.08.090 of the Metropolitan Code providing for the exemption from the minimum distance requirements for the issuance of beer permits by resolution of the Metropolitan Council. RESOLUTION NO. RS2007-2121

A resolution requesting Council-At-Large candidate Ronnie Steine to reimburse the Metropolitan Government for the costs associated with the elections to fill vacancies resulting from his resignation in 2002. The Rules-Confirmations-Public Elections Committee recommended deferment. Mr. Dread moved to defer the resolution, which motion was seconded and adopted by a voice vote of the Council.

RESOLUTION NO. RS2007-2122

A resolution requesting the Metropolitan Police Department to verify proof of insurance coverage during traffic stops.
