Metropolitan Council Meeting
Tuesday, June 12, 2007


The Metropolitan Council met in adjourned session on this date at 7:00 p.m. in the Metropolitan Courthouse.

The invocation was offered by Councilman Jim Hodge.

The Metropolitan Council gave the pledge of allegiance to the American Flag.

The roll was called and the following members were present during the progress of the meeting: Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard and President Gentry (35); Absent: Hunt, Hart, Pepper, Walls, Summers, Alexander (6).

The Minutes of the regular meeting of June 5, 2007, were approved.

BILL NO. BL2007-1445

An ordinance amending Section 5.04.020 of the Metropolitan Code pertaining to the leasing of equipment and motor vehicles. The bill was approved by the Budget and Finance Committee. Mr. Ryman moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (34); “Noes” (0).

BILL NO. BL2007-1446

An ordinance to grant a temporary construction easement to Phillips Development, LLC. (Proposal No. 2007M-079G-14.). The bill was approved by the Planning Commission; Parks, Library, Recreation and Public Entertainment Facility; and Planning, Zoning and Historical Committees. Mr. White moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (34); “Noes” (0).

An ordinance approving an Agreement between the United States Department of the Army and The Metropolitan Government of Nashville and Davidson County for the J. Percy Priest Dam, Section 1135 Project in Davidson County, Tennessee. The bill was approved by the Budget and Finance and Public Works Committees. Mr. White moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (34); “Noes” (0).

BILL NO. BL2007-1448

An ordinance readopting the Code of The Metropolitan Government of Nashville and Davidson County, Tennessee, prepared by Municipal Code Corporation including supplemental and replacement pages thereof, containing certain ordinances of a general and permanent nature enacted on or before October 18, 2006. The bill was approved by the Rules-Confirmations-Public Elections Committee. Ms. Neighbors moved to pass the bill on third reading, which motion was seconded and adopted by the following vote: “Ayes” Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Walls, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (35); “Noes” (0).

BILL NO. BL2007-1450

An ordinance adopting the Capital Improvements Budget and Program 2007-2008 through 2012-2013 for The Metropolitan Government of Nashville and Davidson County as the official Capital Improvements Budget and Program of The Metropolitan Government of Nashville and Davidson County for Fiscal Year 2007-2008. The bill was approved by the Planning Commission; the Budget and Finance and Planning, Zoning and Historical Committees approved the bill with 42 amendments. Mr. Wallace offered Amendment Nos. 1 thru 42 and moved for their adoption, which motion was seconded and adopted by a voice vote of the Council. Mr. Ryman moved to pass the bill on third reading as amended, which motion was seconded and adopted by the following vote: “Ayes” Dozier, Neighbors, Tucker, Briley, Dread, Gilmore, Isabel, Craddock, Murray, Jameson, Cole, Forkum, Ryman, Brown, Gotto, Burch, White, Loring, Page, Greer, Wallace, Whitmore, Crafton, Evans, Shulman, Adkins, Foster, Wilhoite, Hodge, Toler, Coleman, Duvall, Williams, Tygard (34); “Noes” (0).
